1. Acceptance of Terms

By accessing or using UrsMailer (“Service”), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must discontinue use of the platform.

UrsMailer provides email campaign management, SMTP integration, and analytics tools for organizations and businesses.

2. Account Registration & Responsibility

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and to update it when necessary.

Any activity performed under your account is your responsibility. UrsMailer is not liable for unauthorized access resulting from your failure to safeguard login credentials.

3. SMTP & Infrastructure Usage

UrsMailer allows users to connect third-party SMTP servers (including but not limited to Gmail, custom SMTP providers, or enterprise mail servers).

You represent and warrant that you have lawful authorization to use any SMTP credentials provided to the platform.

UrsMailer does not assume responsibility for suspension, blacklisting, or restrictions imposed by third-party email providers.

4. Anti-Spam & Compliance

Users must comply with all applicable email marketing and anti-spam laws, including but not limited to CAN-SPAM, GDPR, and other regional regulations.

All email campaigns must include:

• A valid sender identity
• A physical business address
• A clear and functional unsubscribe mechanism

UrsMailer reserves the right to suspend accounts with excessive bounce rates, spam complaints, abuse reports, or suspected malicious activity.

5. Payment & Subscription

Subscription fees are governed by our Payment Policy. All payments are non-refundable except in cases of verified billing errors.

Failure to pay subscription fees may result in account suspension or termination.

6. Data & Privacy

Users are responsible for ensuring that all contact data uploaded to UrsMailer has been lawfully obtained.

UrsMailer processes data according to its Privacy Policy. We do not sell customer email lists or campaign data.

7. Prohibited Activities

• Sending unsolicited or unlawful communications
• Phishing, fraud, or deceptive marketing practices
• Uploading malware or harmful content
• Attempting to bypass system limitations or abuse infrastructure

8. Limitation of Liability

UrsMailer is provided on an “as-is” basis. We do not guarantee uninterrupted service, delivery rates, or inbox placement.

To the maximum extent permitted by law, UrsMailer shall not be liable for indirect, incidental, or consequential damages arising from use of the service.

9. Indemnification

You agree to indemnify and hold UrsMailer harmless from any claims, damages, liabilities, or expenses arising from your misuse of the platform, violation of laws, or infringement of third-party rights.

10. Termination

UrsMailer reserves the right to suspend or terminate accounts at its sole discretion for violations of these Terms.

Upon termination, access to paid features may be revoked immediately.

11. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable in your operating jurisdiction, without regard to conflict of law principles.
